This Privacy Policy applies to persons who use our Site/App or Services. This Policy does not apply to information we collect from or about drivers, transportation companies, or any other persons who use the OurBus platform under license (collectively "Motor Carriers").

We will take commercially reasonable measures to help protect your personal information in an effort to prevent loss, misuse and unauthorized access, disclosure, alteration and destruction. All the information we have about users is controlled by the laws of the state of New York as applicable. We will keep the information as we need to maintain contact with you, and for our records. We will store and process personal information at locations that could by anywhere across the world. Information is kept securely and access to it is strictly controlled. OurBus uses certain physical, managerial, and technical safeguards that are designed to protect the integrity and security of your personal information. OurBus cannot, however, ensure or warrant the security of any information you transmit to us or store on the Service, and you do so at your own risk. OurBus also cannot guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. If OurBus learns of a security systems breach, then OurBus may attempt to notify you electronically so that you can take appropriate protective steps. OurBus may post a notice through the Service if a security breach occurs. Depending on where you live, you may have a legal right to receive notice of a security breach in writing. To receive a written notice of a security breach you should notify us by email at pr@ourbus.com.

This information shared with us is treated as confidential in nature. OurBus does not sell or trade upon any of the above foregoing information without your consent. We do share information with Motor Carriers to the extent necessary for such Motor Carriers to provide transportation services to you. We do not otherwise share any of your personal information with third parties without your consent and we only use your information as described in the Privacy Policy. If you object to your information being transferred or used in this way please do not use the Site/App.

We take appropriate steps to protect the information you share with us. We have implemented technology and security features and strict policy guidelines to safeguard the privacy of your personal information from unauthorized access and improper use or disclosure and we ensure that our security procedures are compliant with current applicable regulations.

Under no circumstances do we rent, trade or share your personal information that we have collected with any other company for their marketing purposes without your consent. We reserve the right to communicate your personal information to any third party that makes a legally-compliant request for its disclosure.

The information we provide to such third parties, Motor Carriers, or vendors are protected by a confidentiality agreement and are to be used solely for completing the specific project, and the usage of that information will be in compliance with the applicable regulations.

You must only submit to us or our agents, affiliates or the Site/App information which is accurate and not misleading and you must keep it up to date and inform us of changes. Your actual details may be stored with us and you may access this information by logging into your account on the Site/App. You undertake to treat the personal access data confidentially and not make it available to unauthorized third parties. We cannot assume any liability for misuse of passwords unless this misuse is our fault.

When you access or use our Services, we may also automatically collect data information about you, including:

• Login Information : We collect login information as to how and you use our Services, when you install, download, including your access times, communicate with us via third party social media sites, request customer support, or otherwise communicate with us, browser type and language, and Internet Protocol address.
• Personal Information : We collect individual data captured by web forms, such as when registering as a user, or as a user accessing the users' area and requests for information. This information is that which can be used to uniquely identify or contact a single person (such as an individual's name, address, telephone number or e-mail address), information about that individual or such individuals' activities or preferences when such information is directly linked to personal information and any other contact or identifying information you choose to provide. Personal information does not include aggregate information, which is data we collect about the characteristics and activities of users of the Services, from which any personal information has been removed. This Privacy Policy in no way limits or restricts our collection of aggregate information or of non-personal information.
• Location Information : When you use the Services for purchasing transportation, we collect precise location data about the trip from the OurBus to be used by Motor Carriers. If you permit the OurBus App to access location services through the permission system used by your mobile operating system ("platform"), we may also collect the precise location of your device when the App is running in the foreground or background. We may also derive your approximate location from your IP address.
• Transaction Information : We collect transaction details related to your use of our Services, including the type of transportation requested, date and time the transportation was provided, amount charged, distance traveled, and other related transaction details.
• Device Information : We may collect information about your mobile device, including, for example, the hardware model, operating system and version, software and file names and versions, preferred language, unique device identifier, advertising identifiers, serial number, device motion information, and mobile network information.
• Call and SMS Data : Our Services facilitate communications between users and Motor Carriers. In connection with facilitating this service, we receive call data, including the date and time of the call or SMS message, the parties' phone numbers, and the content of the SMS message.

We may use the information we collect about you to:

• Provide, maintain, and improve our Services, including, for example, to facilitate payments, send receipts, provide services you request (and send related information), develop new features, provide customer support to users and Motor Carriers, develop safety features, authenticate users, and send product updates and administrative messages;
• Perform internal operations, including, for example, to prevent fraud and abuse of our Services; to troubleshoot software bugs and operational problems; to conduct data analysis, testing, and research; and to monitor and analyze usage and activity trends;
• Send or facilitate communications between you and the Motor Carriers, such as estimated times of arrival.
• Send you communications we think will be of interest to you, including information about products, services, promotions, news, and events of OurBus and other companies, where permissible and according to local applicable laws; and to process contest, sweepstakes, or other promotion entries and fulfill any related awards;
• Personalize and improve the Services, including to provide or recommend features, content, social connections, referrals, and advertisements.
• We may transfer the information described in this Policy to, and process and store it in, the United States and other countries, some of which may have less protective data protection laws than the region in which you reside. Where this is the case, we will take appropriate measures to protect your personal information in accordance with this Policy.

We may share the information we collect about you as described in this Policy or as described at the time of collection or sharing, including as follows:

• With Motor Carriers to enable them to provide the transportation you request. For example, we share your name, photo (if you provide one) and pickup and/or drop-off locations with Motor Carriers;
• With third parties to provide you a service you requested through a partnership or promotional offering made by a third party or us;
• With the general public if you submit content in a public forum, such as blog comments, social media posts, or other features of our Services that are viewable by the general public;
• With third parties with whom you choose to let us share information, for example other apps or websites that integrate with our API or Services, or those with an API or Service with which we integrate.
• With OurBus affiliated entities that provide services or conduct data processing on our behalf, or for data centralization and/or logistics purposes;
• With vendors, consultants, marketing partners, and other service providers who need access to such information to carry out work on our behalf;
• In response to a request for information by a competent authority if we believe disclosure is in accordance with, or is otherwise required by, any applicable law, regulation, or legal process;
• With law enforcement officials, government authorities, or other third parties if we believe your actions are inconsistent with our User Terms, Terms of Service, or policies, or to protect the rights, property, or safety of OurBus or others;
• In connection with, or during negotiations of, any merger, sale of company assets, consolidation or restructuring, financing, or acquisition of all or a portion of our business by or into another company;
• If we otherwise notify you and you consent to the sharing; and
• In an aggregated and/or anonymized form which cannot reasonably be used to identify you.

You may correct and modify your account information at any time by logging into your online or in-app account. If you wish to cancel your account, please email us at pr@ourbus.com Please note that in some cases we may retain certain information about you as required by law, or for legitimate business purposes to the extent permitted by law. For instance, if you have a standing credit or debt on your account, or if we believe you have committed fraud or violated our Terms, we may seek to resolve the issue before deleting your information. We will comply with an individual's requests regarding access, correction, and/or deletion of the personal data it stores in accordance with applicable law.

We use cookies solely for the purpose of identifying those who contact us and to provide secure personalized access. We use various technologies to collect information, and this may include sending cookies to your computer or tablet or mobile device or any other relevant device. Cookies are small data files stored on your device. Among other things, cookies help us improve our Services and your experience, see which areas and features of our Services are popular and count visits. Most browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove or reject browser cookies. Please note that if you choose to remove or reject cookies, this could affect the availability and functionality of our Services.

We may allow third parties to use cookies, web beacons and other devices or technologies to provide analytics services and serve advertisements to you in connection with the Services. The information collected by these third parties typically includes your IP address, the browser you use to visit our Services, pages viewed, time spent on pages, links clicked, and conversion information. This information may be used by us and third parties to, among other things, analyze and track data, determine the popularity of certain content, deliver advertising and content targeted to your interests and better understand the usage and visitation of our Services and other sites tracked by these third parties. This Privacy Policy does not apply to, and we are not responsible for, third party cookies, web beacons or other tracking technologies and we encourage you to check the privacy policies of these third parties to learn more about their privacy practices.

We use Google Analytics to gather, store and collate information on our visitors and users. It tells us how many unique visitors or users have accessed our services, the pages visited and the quality of access in what order and for how long etc. The service only reports on aggregate visitor data in anonymous form and does not collect personal information like addresses, names, or credit card numbers. For example, if users fill in personal details on a web site using Google Analytics, that data is not collected by or reported on by Google Analytics.

The Services may offer social sharing features (such as the "Like" button) or other tools which let you share actions you take on our Services with other websites, apps and vice versa. The use of such features enables the sharing of certain information with your friends or the public, depending on the settings you establish with the third party that provides the social sharing feature. For more information about the purpose and scope of data collection and processing in connection with social sharing features, please visit the privacy policies for the third parties that provide these social sharing features.

Although OurBus may allow you to adjust your privacy settings to limit access to certain personal information, please be aware that no security measures are perfect or impenetrable. OurBus is not responsible for circumvention of any privacy settings or security measures on the Service. Additionally, OurBus cannot control the actions of other users with whom you may choose to share your information. Further, even after information posted on the Service is removed, caching and archiving services may have saved that information, and other users or third parties may have copied or stored the information available on the Service. OurBus cannot and does not guarantee that information you post on or transmit to the Service will not be viewed by unauthorized persons.

We will send you strictly service-related announcements on rare occasions when it is necessary to do so. For instance, if our service is temporarily suspended for maintenance, we might send you an e-mail message. Generally, you may not opt-out of these communications, which are not promotional in nature. If you do not wish to receive them, you have the option to deactivate your account.

We reserve the right to disclose your personally identifiable information as required by law and when we believe that disclosure is necessary to protect our rights and/or to comply with a judicial proceeding, court order, or legal process served on our website or App or in the good faith belief that disclosure is otherwise necessary or advisable including, without limitation, to protect the rights or properties of OurBus or any of its representatives and affiliates or when we have reason to believe that disclosing the information is necessary to identify, contact or bring legal action against someone who may be causing interference with our rights or properties, whether intentionally or otherwise, or when anyone else could be harmed by such activities.

Please revisit this page periodically to stay aware of any changes to this Policy, which OurBus may update from time to time. If we modify the Policy, we will make it available through the Service, and indicate the date of the latest revision. In the event that the modifications materially alter your rights or obligations hereunder, we will make reasonable efforts to notify you of the change. For example, we may send a message to your e-mail address, if OurBus has one on file, or generate a pop-up or similar notification when you access the Service for the first time after such material changes are made. Your continued use of the Service after the revised Policy has become effective indicates that you have read, understood and agreed to the modified version of the Policy.

If you sign up for, or log into, OurBus using a third party service like Facebook or Google, or link your OurBus account to your account with a third party service like Facebook, Instagram or Twitter, we may receive information about you from such third party service. If you post content to a third party service through the Service, that third party service will also receive that content, which will be visible to anyone that has access to it through that third party service. Some of our web pages utilize framing techniques to serve content to you from our third party partners, while preserving the look and feel of the Service.
